… Dr. __XXX__ has observed that supernatants of Chlamydia infected vaginal and ectocervical cells induced the expression of latent HIV in human macrophage cell line U1. Though some cytokines, such as TNF-a, IL-6, and IL-1, exist in the supernatant, they are not the only factors for the induction of latent HIV because antibodies for these cytokines cannot totally block the effects of the supernatants on the reactivation of HIV. This project is a governmentally sponsored research on interaction of bacteria on HIV infection, and Dr. __XXX__ has become a key member for this study.

(2) Dr. XXX, Professor of pathology and honorary director in Institute of Basic Medical College (IBMC), Chinese Academy of Medical Sciences and Peking Union Medical College (Beijing, China), testified: “Dr. __XXX__ originally and successfully set up the model of atherosclerosis using New Zealand rabbits. De-endothelialization with balloon angioplasty and high-cholesterol diet make rabbits to develop atherosclerosis in six weeks. Administration of simvastatin and gemfibrozil showed significant decrease of total cholesterol and triglyceride level in serum and the neointimal formation in our atherosclerosis rabbit model. Two growth factors, platelet-derived growth factor-B (PDGF-B) and transforming growth factor b1 (TGFb1) were inhibited in protein and mRNA levels. This indicated that lipid lowering drugs, simvastatin and gemfibrozil, may inhibit the release of PDGF-B and TGFb1 in neointima after de-endothelialization. Dr. __XXX__ opened a new avenue to the understanding of the molecular mechanism of lipid-lowering drugs, and his work was published in a professional peer-reviewed journal Chinese Medicine Journal (2001).” (See Exhibit 9)

(3) Dr. XXX XXX, Professor and Program Director of Pathology at New York Medical College, affirmed: “Dr. __XXX__ has played a critical role in developing and carrying out three projects sponsored by United States National Institutes of Health and the Belgian (Flemish) Medical Research Council and has made major and significant contributions to their successful completion. These projects are: 1) identifying a novel regulatory DNA element in the Mycobacterium tuberculosis genome and in other pathogenic mycobacteria; 2) using this element to improve foreign gene expression in recombinant BCG far use in novel anti-prostate cancer vaccines and and in other mycobaeteria to produce recombinant mycobacterial proteins for development of new drug targets for antimicrobial agents; 3) using monoclonal and poiyclonal irrnnunoassays to detect elevated levels of mycobacterial proteins in the circulation of patients with active tuberculosis as a novel method for rapid diagnosis of this disease.

Dr. __XXX__’s exceptional knowledge in different branches of microbiology and his unique skills in molecular biology have been critical to all these projects. His research findings have been presented in an original research article published in Journal of Clinical Microbiology, an internationally recognized, peer-reviewed journal with international circulation. Two additional manuscripts are currently under review and a fourth manuscripts in preparation for publication in other internationally recognized peer-reviewed journals. Dr. __XXX__ has presented his work at international and national conferences, such as the 38th United States-Japan Research Conference on Tuberculosis and Leprosy, Newark, N. .1. (2003), the 103rd general meeting of American Society for Microbiology in Washington, D.C. (2003), and the 4th Annual New York City TB Conference in New York, N.Y. (2002). Two patents based on Dr. __XXX__’s inventions have been filed by New York Medical College. In recognition of his abilities and interests, Dr. __XXX__ was accepted as a member of American Society of Microbiology in 2003.

The research projects to which Dr. __XXX__ contributed especially and significantly are described below:

1. … Dr. __XXX__’s original work successfully identified and experimentally proved that a highly repetitive sequence rptl in the genome of Mycobacterial tuberculosis H37Rv contains enhancer activities for rnycobacterial gene expression. Dr. __XXX__’s pioneering work has therefore enriched our understanding of the molecular pathogenesis of tuberculosis and can be expected to have a long-term impact for many areas of tuberculosis research here in the United States and throughout the world.

2. Based on his discovery of this mycobacterial gene regulatory DNA element, Dr. __XXX__ developed novel expression vector plasmids containing this element for efficient expression of foreign proteins in mycobacterial cells. He has used his system to express a humanprostate cancer marker protein, prostate specific antigen (PSA), in large quantity for use as an anti-cancer vaccine. The idea of application ofBCG as vaccine against cancer specific antigen and thus to prevent tumor metastases is still in the early stage. However, Dr. __XXX__’s work has already offered a practical tool for tumor immunotherapy. Furthermore, in vitro expression of proteins from virulent mycobacteria in harmless niycobacteria could permit production of many more proteins in more native structures than are currently possible using Eschcrichia ccili, the current standard system for these studies. The available of Dr. __XXX__’s all mycobacterial system for mycobacterial protein production is a major step forward and can again be expected to have important future benefits for patient health both in the United States and worldwide.

3. … Dr. __XXX__ played an important part in developing this test using monoclonal antibodies binding to a major mycobacterial secretary protein (Ag85) found in the circulation of patients with tuberculosis and using this test to show that it was an appropriate diagnostic assay for tuberculosis that did not depend on the patient having an intact immune response. It can be expected that this novel diagnostic assay for tuberculosis, the development of which Dr. __XXX__ has made a major contribution, will also prove to be a major contribution to public health in the United States and worldwide.

I have been impressed by Dr. __XXX__’s exceptional knowledge of microbiology and vaccinology and his devotion to human health sciences. His creative, well-organized work and the integration of his solid microbiological background with his expertise in human health research can be expected not only lead to efficient solutions of current infectious diseases, but also to put his in the frontline of these research areas.” (See Exhibit 13)

(4) Dr. Raj K. Tiwari, Graduate Program Director and Associated Professor in the Department of Microbiology and Immunology at New York Medical College, highly commended: “Dr. __XXX__ has made internationally recognized significant contributions to infectious diseases and cancer research like the discovery of a mycobacterial gene regulatory DNA element, study of mechanism of anti-tumor compound antiestrogen indole-3-carbinol (I3C) and the regulation of heat shock protein gp96 by cytokine IFN-g and IL-2. These contributions have brought, and will also bring substantially and intrinsically important benefits to the tuberculosis and cancer research. As his co-mentor and an expert in Dr. __XXX__’s research areas, I strongly believe that Dr. __XXX__ is a scientist of exceptional abilities in the field of biomedical science and his significant accomplishments have impacted these research areas significantly. I believe the United States will greatly benefit if Dr. __XXX__’s petition for permanent residency is granted.

… Dr. __XXX__ has been taking a leading part in the investigation of cellular target proteins by I3C in estrogen positive breast cell lines. His results indicated that I3C exerts its antiestrogenic effect by intervention in the E2-estrogen receptor signal transduction pathways, which includes several DNA binding element, such as AP2 and SP1. Also, gene array data showed that biochemical targets of I3C could be multiple and more than the estrodiol-medicated functional proteins. Dr. __XXX__’s results enlarged our understanding of chemoprevention compound I3C and published in two peer-reviewed articles in European Journal of Cancer Prevention (2002) and Nutrition and Cancer (2001). Dr. __XXX__ also presented these data at the 94th and 95th Annual Meetings of American Association of Cancer research in 2001 and 2002 respectively.

… Dr. __XXX__ performed electrophoresis mobility shift assay to recognize the induced transcription factors that enhanced gp96 level under the treatment of IFN-g and IL-2. Interferon-activation sequence (GAS) located in the promoter region of gp96 showed increased binding to nuclear proteins and STAT1 protein, a classic transcription factor for GAS also has correlated increase. These results reveal a possible link between the IFN-g and IL-2 to the enhanced expression of gp96 through the interaction of STAT1 protein with GAS DNA element. It also offered a theoretical basis for cancer immunotherapy using gp96 as a bridge. A paper reporting all these data has been published in Cell Stress and Chaperone in 2003.

In addition, Dr. __XXX__ also made a successful work on ‘Regulation of Gene Expression by a Novel Mycobacterial Repetitive DNA Sequence’”. (See Exhibit 19)

(5) Dr. XXX, the Chief and Associate Professor of Pediatric Infectious Diseases, Department of Pediatrics, XXX School of Medicine, pointed out: “Dr. __XXX__ established himself as an expert in the field of biamedicinul research, particularly in the research areas of microbiology, vaccination and cancer research. He investigated the molecular pathogcncsis of Mycobactertsm lubercwlosis by identifying a novel gene regulatory DNA element, rptl. rptl is a highly repetitive DNA element in the gcnome of Mycobactertal tuberctrlosis H37Rv. When introduced into mycobacterial expressive vector, rptl works as a promoter and an enhancer for the expression of reporter gene. A new recombinant BCG was also generated based on Dr. __XXX__’s study of rptl. In this novel vaccine, a foreign gene can be expressed effectively in BCG celln. Two manuscripts and a patent have been submitted on this project. Dr. __XXX__ also presented his work at several national and international meetings including the annual meeting of American Society of Microbiology, US-Japan cooperative medical science program, the 38th Tuberculosis and Leprosy research conference, and others.

... Dr. __XXX__ made quick contribution to this project by finishing the IL-6 and TNF-a blocking experiment. This work will be present in the 42nd Annual Meeting of the Infectious Diseases Society of America in 2004.” (See Exhibit 24)

… Dr. __XXX__ is a scientist with unique expertise in the field of tuberculosis pathogenesis and vaccination. He experimentally proved that a highly repetitive mycobacterial DNA element, rpt1, has specific binding with proteins from the lysates of BCG, Mycobacterium tuberculosis, and Mycobacterium smegmatis.

… Dr. __XXX__’s work has been reported in the 103rd annual meeting American Society of Microbiology and 38th Tuberculosis and Leprosy research conference, US-Japan cooperative medical science program.

Dr. __XXX__ is now working as a research scientist in Infectious Diseases Division, Department of Medicine, XXX School of Medicine. He applies his experience in tuberculosis to HIV research and focus on the innate immunity with HIV infection. As a newly developed life-threaten infection, HIV significantly affects our society physically and morally. The research of HIV infection is far from needed, especially the immune response to HIV virus, which is the basis for HIV treatment and prevention. Dr. __XXX__ has found that low dosage of lipipolysaccharide and lipooligosaccharide can delay the HIV infection to the human macrophage and CD4 T cells. This phenomenon opens a gate to a new field in understanding the immune response to HIV and potential HIV treatment.” (See Exhibit 31)

(7) Dr. XXX XXX, Dean of the Graduate School of Basic Medical Sciences and Professor of Physiology at New York Medical College, wrote: “His (Dr. __XXX__’s) doctoral dissertation focused on tuberculosis, a major health problem in the United States and worldwide. His research identified a regulatory clement in the tuberculosis bacterium that appears to be important in the pathogenesis of this organism. It may also provide a target for a workable tuberculosis vaccine, for which Dr. __XXX__… filed a patent application. More recently, he has been working on the human immunodeticiency virus (H1V).

Dr. __XXX__’s productivity as a scientist is already apparent, despite his relatively young age. He produced usable research results within mere months of beginning graduate school, and has already produced two research reports in the first six months of his post-doctoral appointment. He has already filed two patent applications, further demonstrating his scientific creativity.

(8) Dr. XXX XXX, Professor and Vice–chair for Researcg, Department of Medicine, UMDNJ Center for BioDefense at XXX Medical School, NJMS-National Tuberculosis Center, confirmed: “Dr. __XXX__ was the first scientist to successfully perform electrophoresis of mobility shift to show that rpt1 has specific binding with mycobacterial proteins from BCG, Mycobacterium tuberculosis, and Mycobacterium smegmatis. Then, he initially introduced rpt1 tandem into a mycobacterial expression vector. The rpt1 tandem increased the expression reporter gene when introduced between original promoter and reporter gene or replacing the original promoter. Dr. __XXX__’s research results indicated the rpt1 sequence play roles as enhancer and promoter in mycobacterial gene expression in vivo. Dr. __XXX__’s work provided new understanding of a novel mycobacterial gene regulatory element and has been reported at several international meetings.

The expression system generated by Dr. __XXX__ also showed positive results when introduced into BCG system. BCG is the only vaccine for tuberculosis and the safest vaccine for human being. The modification of BCG using recombinant DNA technology aimed to improve the efficacy of tuberculosis vaccination and even exploited it to treat or prevent other diseases, such as tumor immunotherapy. Dr. __XXX__’s system has very practical value to immune patients with prostate cancer with human prostate cancer marker that could prevent the metastasis of micro-follicle of tumor cells after surgical removal of the original tumor. Therefore, NYMC patented Dr. __XXX__’s work.

Another interesting part of Dr. __XXX__’s work is to recognize the interaction of mycobacterial DNA with host proteins. Dr. __XXX__ demonstrated that rpt1 has specific binding with human nuclear protein lysate from U937, A549, and HeLa cell lines. The proteins purified using pull-down experiment from different cell lines share a common protein, Ku70. Ku70 is a subunit of DNA-dependent protein kinase (DNA-PK). rpt1 also showed specific activation of DNA-PK in low dosage. Since DNA-PK has shown to link the activation of NF-kB pathway with the endocytosis of bacterial DNA, rpt1, as a mycobacterial DNA element, could interact with host cells by affecting the activity of host DNA-PK.

Dr. __XXX__ was the primary researcher to creatively develop all above knowledge of mycobacterial pathogenesis using his vast expertise and perseverance. His work is thus of obvious and crucial significance to the US healthcare and economy and to improvement of disease management in patients. (1) Study of the mechanism of cholesterol-lowering drugs.

· The project’s objective and significance

Atherosclerosis is a chronic pathological process change of arterial wall in which deposits of fatty substances, cholesterol, cellular waste products, calcium and other substances build up in the inner lining of an artery. This buildup is called plaque. Atherosclerosis plagues disturb the normal blood flow or even totally block the blood vessel. When such event happens in major arteries, such as coronary arteries or cerebral arteries, acute ischemia of heart or brain will lead to heart attack or stroke, which is life-threatening. Lipid profile and metabolism is very important for the development of atherosclerosis plaques. Too much cholesterol in the blood will damage the endotheXXXm (the inner side of blood vessel). The injured endotheXXXm will trigger the platelet aggregation, release of inflammation factors, and the accumulation of inflammation cells, such as macrophages and neutrophil cells. In such pathogenic environment, atheroscleorosis plaque will form. Today, cardiovascular diseases, most caused by atheroscleorosis, is the number one killer in American society. Therefore, lipid-lowering treatment for the prevention of heart attack attracts interests from various aspects.

· Dr. __XXX__’s Significant Role, Contribution, Impact and Recognition in this Research

To elucidate the protection of lipid-lowering drugs on high-lipid model, rabbits are widely used in laboratory to setup high-cholesterol model. Most researchers give high-cholesterol diet to rabbit to increase serum cholesterol of rabbit since rabbits have low tolerance of high-level lipid. Dr. __XXX__ successfully improved this method by adding endothelial injury by surgery. Putting two major atherosclerosis factors together--mechanic injury and high-cholesterol diet, his method shortened the time for model development from 3 month to 6 weeks with comparable results. New Zealand white rabbits were used to perform balloon damage of whole aorta (the largest artery connected directly with heart). A 2mm diameter catheter was inserted into the femoral artery and went against blood flow to reach aorta. Transit air filling extend a balloon on the tip of the catheter. The direct pressure of balloon onto the artery injured the endotheXXXm. After the injury, rabbits were raised with high-cholesterol diet combined with or without lipid-lowering drug, simvastatin and gemfibrozil. After six weeks, we observed a significant decrease of the number and extent of atherosclerosis plaques on the aorta of rabbits with drug treatment compared to those without lipid-lowering drugs treatment. Two growth factors, plate derived growth factor-b (PDGF-b) and tissue growth factor-1 (TGF-1), are well known to be involved in the formation of atherosclerosis plaques. Dr. __XXX__’s experiments showed that lipid-lowering drug inhibit the atherosclerosis plaques by suppressing the levels of PDGF-b and TGF-1, and his research provided further proof for the prevention effects of lipid-lowering drugs on atherosclerosis and also explained partially the mechanism behind this phenomenon. The data were published in Chin Med J, Sep; 114(9): 976-982, 2001. (See Exhibits 9-10).

(2) Study in the role of a novel mycobacterial DNA element in mycobacterial gene expression and its application in the vaccine development for tuberculosis. (Funded by National Institute of Health Grant AI 37014)

· The project’s objective and significance

Mycobacterium tuberculosis infects one third of the world’s population and is among the leading causes of death worldwide due to a single infectious agent. Eight million new cases of TB appear each year and two million die from TB. This situation has been worsened by the HIV epidemic and the emergence of antibiotic-resistant mutants. It is not surprising that the World Health Organization has proclaimed TB represents a global emergency.

BCG, the only available TB vaccine used for humans, was developed in the early twentieth century by continuously culturing pathogenic M. bovis until the subcultured strain lost its pathogenicity but still could provoke a protective immune response against TB in a vaccinated person. Neonatal BCG vaccinations protect children against primary tuberculosis in the range of 50–70%. However, in older age groups, the protective efficacy of BCG against pulmonary disease ranges from 0 in India and Africa to 80% in Europe and the northern US. A higher efficient vaccine for TB is imperative. This project is to improve the antigen expression in a recombinant BCG by introducing constructed plasmids into cells and to understand the mechanism of mycobacterial gene regulation.


· Dr. __XXX__’s Significant Role, Contribution, Impact and Recognition in this Research

A. He is a pioneering researcher to identify a highly repetitive sequence in the genome of mycobacteria and describe the characteristics of this sequence as a gene regulatory sequence.

The whole genome sequence of M. tuberculosis H37Rv was completed in 1998, which provides a powerful tool to study molecular pathogenesis of TB. Dr. __XXX__ initially performed BLASTN analysis (P<0.004).

II. (2). Based on his deep interest in the sensory neurosciencel research and his high academic performance, Dr. __XXX__ was matriculated as a postdoctoraldoctoral researcher by the Center for XXX XX XXX, Departmemt of XXX, XXX University.

In January 1999, Dr. __XXX__ started his research as a Ph.D candidate in Department of Pathology, New York Medical College (NYMC)[1]. He contributed significantly to the study in the gene regulation of Mycobacterium tuberculosis and vaccination improvement of tuberculosis. Dr. __XXX__’s noteworthy work was reported at several regional and international conferences, and his discovery of a potential mycobacterial regulatory element and the construct of a novel plasmid have large application value for vaccination of tuberculosis. His substantial experimental results, solid basis of modern basic medical research and influent expression for scientific communication are all the essential factors for proving his exceptional skills and unique expertise in the field of his endeavor. II. DR. __XXX__ QUALIFIES FOR PERMANENT RESIDENCE AS AN ALIEN WHO IS AN ADVANCED DEGREE PROFESSIONAL IN THE FIELDS OF BIOMEDICINE, VACCINATION AND IMMUNOLOGY OF INFECTIOUS DISEASE AND CANCER PREVENTION

Dr. __XXX__ qualifies for permanent residency as a foreign national who is an advanced degree professional in the fields of sensory neuroscience, including visual and auditory information processing, and comparative study of tinnitus.

II. (1). Dr. __XXX__ had outstanding education and working experiences in China.

In 1999, Dr. __XXX__ received his Ph. D degree from XXX University, China. During his six years’ study from his admission in 1990, he had published four peer-reviewed research papers. Upon graduation, Dr. __XXX__ was recruited as a postdoctoral fellow in the Brain Research Center, XXX University, Shanghai, China. offered a position of Assistant Professor in Department of Pathology, Institute of Basic Research of Medicine (IBRM)[2], Chinese Academy of Medical Sciences (CAMS) due to his Ph.D excellent academic and research performance.

At IBRM, Dr. __XXX__’s research was focused on research of lipid and atherosclerosis. He was a key member in the research project funded by “National Hi-Tech 863 Plan”. Atherosclerosis is the major reason of heart attack and stroke. These cardiovascular diseases are becoming or have been the first killer in many countries, especially developed countries. Dr. __XXX__’s work demonstrated that oxidized lipoprotein is a critical factor to lead to endothelial damage and induced the formation of atherosclerosis plague. Lipid-lowering drug, simvastatin and gemfibrozil, decreased serum total cholesterol and triglycerides and then reduced atherosclerosis plaques in high cholesterol diet rabbits with de-endothelialization injury. His results were published in Chinese Medical Journal, the proceeding of the Chinese Association of Pathology. He was also accepted as a member of the Chinese Association of Pathology due to his contribution to lipid research. In addition, he worked as an Assistant Professor of Nursing School of XXXX.
[1] He is leading one of the most dynamic research programs underway anywhere in the country—development of topical microbicides to prevent HIV infection and investigation on the pathogenesis of HIV infection. Because the development of effective, affordable vaccines for HIV has proven so elusive, interest in as an alternative approach to prevention has soared in the last two years. Dr. XXX’s group has been awarded two major federal grants, totaling over $2.4 million in 2003 alone ($11 million in all) to study HIV microbicides. Two potential compounds, "SAMMA" and Pro2000, have been heavily studied and the latter is already in clinical trial.

This office represents Dr. __XXX__, Ph.D. in his immigrant petition and national interest waiver application under Section 203 (b) (2) of the Immigration and Nationality Act. Dr. __XXX__ is a full-time Research Scientist at Center for XXX XX XXX, Department of XXX, School of Medicine, XXX University.

He has made several novel unique discoveries in the fields of sensory neuroscience, particularly in auditory pathways and visual processing mechanism in the cortex. Dr. __XXX__ has been playing a key role in the federally funded research projects. He has earned widespread acclaim due to the overall impact and implications of his new findings in the field. All his demonstrable achievements have been extensively shared and recognized throughout the field. All of these achievements have enabled his to greatly exceed others in his profession.

Dr. __XXX__ has established himself as a critical contributor to the national research efforts in sensory neuroscience, especially the mechanism of hearing and tinnitus, the auditory pathway and physiology: (1) He discovered that projection for inferior olive to the granular cell domain in the cochlear nucleus; he identified the pathway of the projection from inferior olive to the cochlear nucleus and his research provided further proof for the role of granular cell domain in auditory signal processing; (2) He is a pioneering researcher to identify a possible new pathway for tinnitus; he discovered the projection from lateral reticular nucleus to the cochlear nucleus and characterized the nature of the synapses of these connections. Dr. __XXX__, initially performed a novel surgery method to approach these brainstem nuclei, the method can minimize the contamination of injection of the tracer used to identify the projections. The method Dr. __XXX__ creatively set up is based on the current knowledge of brainstem neuroanatomy and characteristics of these nuclei. He is the foremost scientist to prove that the projection of lateral reticular nucleus is involved tinnitus and the projection from inferior olive to cochlear nucleus may involve the plasticity of the neurons in dorsal cochlear nucleus. His results enriched the knowledge of auditory neuroscience. Identification of these novel neuronal pathway has enormous meaning for the basic research and application. Dr. __XXX__ contributed significantly to the research on the relationship between cochlear nucleus and cerebellum and deeper cerebellar nuclei. Besides, he has identified the mossy fiber systems in the cochlear nucleus from pontine nuclei, lateral reticular nucleus, cuneate nucleus and spinal trigeminal nucleus. He is the first person to use the combination of BDA and FluoroGold for neuronal tracing; this method greatly increase the efficiency of neuronal tracing studies. Dr. __XXX__ took a significant and original part in examining the relationship between the inferior colliculus and substantia nigra. His selective effect warranted a further search for the integration of nonauditory and auditory system at various level in the brain. Dr. __XXX__ discovered that there is a reciprocal connection between the inferior colliculus and substantia nigra, and Dynorphin is involved in the interaction. He is the first scientist to demonstrate the tuning distribution of c-Fos in the auditory system in the bat, Myotis Chinesis. He also successfully analyzed the inhibitory and excitatory neurotransmitters in the bat auditory system. Dr. __XXX__ discovered that there is a unique distribution of excitatory and inhibitory system in the bat auditory system As a key investigator for this project, Dr. __XXX__’s strong neuroanatomical background promoted the progress of this study significantly. (6) Dr. __XXX__ originally and successfully developed an efficient system to screen the inhibit effects of chemicals on the remission of latent HIV. His research work contributed significantly to the optimization of a system to detect the inhibition of latent HIV reactivation by PRO 2000, SAMMA and their combination with other multi-targeted anti-HIV reagents. Dr. __XXX__ also innovatively designed the whole system on a 96-well plate platform, which can test 96 samples simultaneously, and set up the computer-aid experimental design and data analysis. With his stable system, the best inhibition of the reactivation of latent HIV by RPO2000, SAMMA combined with other multi-targeted anti-HIV reagents is screened out efficiently. (7) Dr. __XXX__ discovered that supernatants of C. trachomatis and N. gonorrhieae infected productive tract epithelial cell induce latent HIV-1 expression. To study the mechanism of HIV induction, His work indicates that gonococcal and chlamydial infections of productive epithelial cells could indirectly induce the reactivation of latent HIV through the secretion of cytokine TNF-a and IL-6. Dr. __XXX__ demonstrated the complexity of effect of gonococcal and chlamydial infections to HIV: not only cytokines can activate HIV, but also other components in the supernatant, such as the part of bacteria of gonococcus and chlamydia plays a role for HIV reactivation. He further research focuses on how the bacterial components activate the HIV. Dr. __XXX__ also discovered that Gonococcal surface adhesin lactosyl lipooligosacchride (LOS) interact with host receptor and activate the latent HIV. Gonococcal invasion of epithelial cells involves the phase-variable expression of adhesions including pili, opacity-associated (Opa) proteins, LOS, and PorB porin protein, with the role of pili and Opa the best characterized. LOS has obtained little attention. Five LOS isolated from clinical strains and laboratory strains of Gonorreahea were tested for their potential to affect HIV infection. Dr. __XXX__’s research provided the original evidence that same amount of LOS has higher induction of HIV reactivation in U1 cell comparing to lipopolysacchride (LSP). LSP has been commonly accepted as an activator of immune response to bacterial component through Toll like receptor 4 (TLR 4). His observation is the first time to indicate a stronger agonist of TLR4 and the possible activator of latent HIV virus. Dr. __XXX__’s results aroused much interest from other researchers in field.

Dr. __XXX__’s accomplishments in the above researches clearly show that Dr. __XXX__, as a leading team member, has played a key role in many research projects, which serve the development and implementation on a national scope. It will be impossible to find another scientist to fill this role because of his quality as an exceptional scientist, his unique combination of skills and his expertise beyond that of other professionals who has worked in the field. Dr. __XXX__’s individual significant achievements represent major advances in the field and have been also acclaimed by other experts worldwide. Other individuals could not achieve or duplicate Dr. __XXX__’s accomplishments, obtain the same or similar results. Dr. __XXX__, and only Dr. __XXX__ can present significant benefits to the field of his expertise.

Dr. __XXX__ has produced a number of high quality publications and patents in his expertise research field in prestigious and internationally circulated journals such as Biochem. Biophys. Res. Comm , Cell Stress & Chaperons, Nutrition and Cancer, European Journal of Cancer Prevention, J Clin Microbiol., Chin Med J., etc. More markedly, some of his publications have been cited widely in a variety of prestigious peer-reviewed journals by many national and international research groups at universities, research institutes, and governmental agencies. Dr. __XXX__ has become a member of the American Association for the Advancement of Science (AAAS) and the New York Academy of Science (NYAS).

During past more than thirteen (13) years, Dr. __XXX__ has successfully performed several challenging biomedical research projects of atherosclerosis, pathogenesis of TB, vaccination development for TB, innate immunity of HIV, HIV microbicide development and the study of the mechanism of anti-tumor drug I3C. With his unique ability and extensive research experience in these areas, Dr. __XXX__ has made several innovative discoveries, which have opened new avenues for the U.S. public health -related research. His significant contributions and unique ability are considered to greatly exceed others in his profession. Dr. __XXX__’s contributions to the biomedical research areas have been widely recognized by well-known experts in the world.

We respectfully believe that this case meets all the standards for national interest immigration that have been established by the U.S. government, the INS Administrative Appeals Unit (AAU) and the various INS Regional Centers including yours, even though what constitutes national interest in the context of national interest waiver immigration petition has been controversial and there were no uniform standards when this category was created in the 1990 INA.

First, the present case has provided strong evidence that Dr. __XXX__ meets factor No. 4 set forth in the INS AAU decision Matter of ___, ESC 92 091 50126 (AAU July 21, 1992). To determine whether the alien's admission would be in the national interest, the AAU pointed to the following factors: (1) the alien's admission will improve U.S. economy; (2) the alien's admission will improve wages and working conditions of U.S. workers; (3) the alien's admission will improve educational and training programs for U.S. children and under-qualified workers; (4) the alien's admission will improve healthcare; (5) the alien's admission will provide more affordable housing for young, aged or poor U.S. residents; (6) the alien's admission will improve the U.S. environment and lead to more productive use of natural resources; or (7) the alien's admission is requested by an interested U.S. government agency (See Exhibit 1).

As discussed in details below, Dr. __XXX__ has unique expertise and significant contributions to the fields of biomedicine, vaccination and immunology of infectious disease and cancer prevention, particularly in atherosclerosis, pathogenesis of TB, vaccination development for TB, innate immunity of HIV, HIV microbicide development and the study of the mechanism of anti-tumor drug I3C for the U.S. health care, technological competitiveness of biomedical sciences and the knowledge on mechanism research and vaccination and drug development for infectious diseases, especially for the major infectious diseases TB and HIV (Factor No. 4). Dr. __XXX__’s research is clearly recognized as national interest of this country.

Second, we also believe that Dr. __XXX__’s research falls within the ruling and spirit of several other decisions by the INS including Matter of ___, NSC A70 832 675(AAU July 22, 1993). In that case, a national interest waiver was granted to an alien who planned to work on a federally funded project. The AAU concluded that the alien's work in the U.S. appeared to be in the national interest of the U.S. In a similar case, the AAU also approved the waiver request of an engineer who was to work for a government contractor on several projects, including the super-conducting collider and other projects concerning defense, the environment and transportation. Matter of __, NSC A 70 832 477 (AAU July 16, 1993). Likewise, the AAU approved a waiver request for a scientist planning to work for a government contractor. The petitioner in this case was a manufacturer of optical components used in a naval weapon defense system. Matter of __, NSC A29 871 376 (AAU July 30, 1993). In the present case, as a key researcher, Dr. __XXX__ has played an independent and irreplaceable role in the projects of “Study in the role of a novel mycobacterial DNA element in mycobacterial gene expression and its application in the vaccine development for tuberculosis”, “Development and test of novel microbicide and the mechanism of theses microbicide” and “Monoclonal antibody produced to detect the Ag85 in the serum of TB patients” funded by NIH (Grant No: AI 37014, U19 HD43733) and by Public Health Service (Grant No: AI42452, AI45925, AI36989). Thus, Dr. __XXX__'s research is clearly in the national interest of the United States. (See Exhibit 2).

Third, and more importantly, the submitted documentation including the strong testimonies from well-known experts in the field has clearly established that Dr. __XXX__’s research and qualifications have met the three prong test set forth in the Matter of New York Dept. of Transportation (AAO, Aug. 1998). Dr. __XXX__ has been playing a significant role and has made significant contributions in a broad range of biomedical areas, including atherosclerosis, pathogenesis of TB, vaccination development for TB, innate immunity of HIV, HIV microbicide development and the study of the mechanism of anti-tumor drug I3C, which is consistent with the U.S. government policy to improve the national healthcare.

The following attempts to address the new criteria set forth in the Matter of New Dept. of Transportation, which your Center has been following in adjudication of the national interest waiver cases. I. SUMMARY XXXtechnology comprises any technological developments on the XXXXmeter scale, usually 1 to 100 nm. (One XXXXmeter equals one billionth of a meter.) The research and development of XXXXscale science and technology could lead to breakthroughs in areas such as materials and manufacturing, XXXXscience, healthcare, environment and energy, biotechnology and agriculture, computation and information technology, and national security. The impact of XXXtechnology on the health, wealth, and lives of people could be at least as significant as the combined influences of microelectronics, medical imaging, computer-aided engineering, and man-made polymers developed in this century. Therefore, the research on the sensory nXXXscience and technology is of strategic importance to the national economy as well as the human life of everyone.
My current research in XXX, a world-renowned university, has been focusing on XXXXscale modeling and simulation of silicon XXXXstructures and carbon XXXXtubes, a very important research field of XXXscience and technology. My unique experience and abilities have set me apart from other researchers in this field. I graduated from the best university of XXX  ****** University  and ranked top 2% in my college. During my Ph.D. and postdoctoral period in ****** University, I have made a number of novel discoveries in XXXscience and technology research, which have both academic and industrial significance. My research has led to more than ten high quality publications. My publications are widely recognized and cited by the researchers in my field from all over the world. II. MY RESEARCH ON XXX SCIENCE AND TECHNOLOGY IS OF THE NATIONAL INTEREST OF THE UNITED STATES. Technology is the major driving factor for growth at every level of the U.S. economy. XXXXtechnology is pervasive in its applications across nearly all technologies. So far, XXXXtechnology has been recognized to make great impact in a wide range of fields: materials and manufacturing, XXXXscience and computer technology, medicine and health, aeronautics and space exploration, environment and energy, biotechnology and agriculture, and national security. Therefore, the research on XXXXscience and technology is necessary to maintain and improve the position of US in the world marketplace and it is of national interest of the United States.
The research on silicon materials is very extensive due to the critical role of silicon in electronics industry. However, as the size of silicon-based device becomes smaller and smaller and approaches XXXXmeter regime, the properties of XXXXscale materials and devices are far from clear yet. The research of XXXXscale materials and devices based on silicon and carbon, which is my current research topic, aims to improve the fundamental understanding as well as practical applications of this class of novel materials. This research has a great impact on the whole nation in the following three major aspects:
1. Improving Economy
The technology innovation is the key for US to maintain leadership in the world economy. The XXXXtechnology leads to great technology innovation in a variety of industries: such as electronics industry, manufacturing industry, chemical and pharmaceutical industry. Therefore, XXXXtechnology can significantly change a large cross-section of the economy in the next decades in industrialized countries. ******* include extension of Moore’s law behind microelectronics, biologically based devices and biomimetics, new functional materials (constructive, catalysts, pharmaceuticals, etc.), and portable electronic devices. The research of XXXXscience and technology will decide whether US can still lead the world economy in the next few decades.
2. Improving Healthcare
Living systems are governed by molecular behavior at XXXXmeter scale. The molecular building blocks of life—proteins, nucleic acids, lipids, carbohydrates and their non-biological mimics—are examples of materials that possess unique properties determined by their size, folding, and patterns at the XXXXscale. XXXtechnology can radically change the study of basic biological mechanisms, as well as to significantly improve the prevention, detection, diagnosis and treatment of diseases and adverse medical conditions. The key to this is that XXXXtechnology operates at the same scale as biological processes, offering an entirely unique vantage point from which to view and manipulate fundamental biological pathways and processes. Most other technologies require the study of large numbers of molecules purified away from the cells and tissues in which they usually function; XXXtechnology offers ways to study how individual molecules work inside of cells. Therefore, XXXscience and technology will significantly improve our ability to deal with all kinds of diseases.
3. Improving National Security
XXXtechnology also plays an important role in the US national security. For example, The Department of Defense recognized the importance of XXXXstructures over a decade ago and has played a significant role in nurturing the field. Critical defense applications include (a) continued information dominance through advanced XXXXscience, identified as an important capability for the military; (b) more sophisticated virtual reality systems based on XXXXstructured electronics that enable more affordable, effective training; (c) increased use of enhanced automation and robotics to offset reductions in military manpower, reduce risks to troops, and improve vehicle performance; for example, several thousand pounds could be stripped from a pilotless fighter aircraft, resulting in longer missions, and fighter agility could be dramatically improved without the necessity to limit g-forces on the pilot, thus increasing combat effectiveness; (d) achievement of the higher performance (lighter weight, higher strength) needed in military platforms while simultaneously providing diminished failure rates and lower life-cycle costs; (e) badly needed improvements in chemical/biological/nuclear sensing and in casualty care; (f) design improvements of systems used for nuclear non-proliferation monitoring and management; and (g) combined XXXX and micromechanical devices for control of nuclear defense systems. The objective and significance
In 19**, due to my excellent academic performance and demonstrated exceptional research abilities, I was admitted as a Ph.D. candidate in Department of Chemistry at **** University with full scholarship. My research focus is theoretical modeling and simulation of XXXscale materials and devices. As discussed above, XXXXscale materials and devices will have wide applications in a variety of fields. However, the properties of XXXmaterials and the behaviors of XXXdevices are not fully understood yet. Many properties and behaviors cannot be measured because of the extreme smallness of the systems or difficulty in preparing uniform samples. Therefore, the XXXscale modeling and simulation are very critical in the study on XXXXscale materials and devices. The aim of my research is to improve the understanding of the properties and behaviors of XXXXmaterials and XXXXdevices, as well as provide a guideline for the industrial in fabricating these types of tiny and useful devices.

After joining Prof. ****** and Prof. ****groups in 1999, I started to work on the modeling and simulations of two kinds of XXscale systems, silicon XXXXstructures and carbon XXXotubes. Their importance of applications was also explored.
For the first time, I solved a long-standing puzzle in the field of XXXXscience and technology by using quantum mechanical simulation. I successfully explained the puzzling phenomena that hydrogen-passivated Si XXXXcrystals luminesce in the blue whereas oxide-passivated Si XXXXcrystals luminesce in the yellow-red after systematically studying the effect of different types of capping layers on silicon XXXXcrystals. This discovery has great academic significance as well as important industrial implication. My research results enrich the chemistry and physics of XXXXmaterials and also provide a theoretical basis for designing XXXXscale optical and electric devices, which are the elements of XXXXtechnology-driven products. Based on my outstanding work, I published two papers in the best journals in the fields of XXXXscience and chemistry. They have been widely cited by the research groups from all over the world, which reflects the importance and creativity of this work. Due to both academic and industrial significance of my work, I was invited to present my research results on two prestigious international meetings  ****** Conferences (****) and ******(***) National Meeting in the August and September of ****, respectively.
I was the first researcher to accurately predict the structural and electrical activity of dopants in Si XXXXcrystals and Si channel near Si/Oxide interfaces in Field Effect Transistors (FETs). This type of atomic scale study has both academic and industrial significance since electronic circuits keep shrinking the size of silicon-based field effect transistors are approaching the atomic scale. My research results offer valuable guideline as to how to fabricate XXXXmeter scale transistors. My research about doped silicon XXXXcrystals gives the first examination of the chemical trends in donors and acceptors in silicon XXXXcrystals using a first principles approach. This provides the first look at the properties of a full class of impurities in small XXXXcrystals, information that is not yet accessible to controlled experiments. This provides new fundamental insight to screening and electronic states in this prototypical XXXXcrystal system. This original work was quickly accepted for publication at the best archival journal in the field of physics.
I also carried out state-of-the-art quantum mechanical calculations using static and time-dependent Density Functional Theory and extensively studied a particular metallic tube structure (5,5) as a function of tube length. These calculations allow me to provide explicit electronic structure properties and to examine how the band-like behavior develops for long tubes. For the first time, I discovered a new type of electronic absorptions that are characteristic for tubes of moderate length but vanish for very long tubes. This work is of academic significance both for its predictions about the properties of short tubular molecules as well as its implications for the infinite length XXXXtube. My discovery provides a theoretical basis to build an apparatus to measure the length of carbon XXXXtubes by using spectroscopic methods. Due to the significance and strong interest to all people attempting to use the tubes, this work was quickly accepted and published in ***********, the best archival journal in the field of chemistry. In ****, 20**, I was invited by ***** XXXXscale Science and Engineering Center to give a talk about finite-length carbon XXXXtubes at the thrust area strategy meeting. I write this letter to show my strongest support for Dr. XXX’s application for permanent residence in the United States. Based on his outstanding abilities and dedication as a researcher in the field of biological sciences, I can say with complete assuredness that Dr. XXX has contributed and will continue to contribute substantially to our understanding of biomedical science and human disease, a health care issue that is of national interest and significance.

Dr. XXX currently holds Research Fellow appointments at Massachusetts General Hospital and Harvard Medical School which have selected him from thousands of outstanding researchers and scientists because he stands out greatly. Dr. XXX has shown outstanding abilities in the laboratory’s pursuit of finding the cause(s) and ultimately a cure for Multiple Sclerosis (MS). MS is a demyelination disease of the ventral nervous system that affects over 200,000 people in the United States alone, and it is critically important that a cure for this disease be found. Dr. XXX’s previous work here in the United States focused on the role of the SREBP proteins, which are global regulators of lipid and fatty acid synthesis and uptake. He has brought his experience with these proteins this research and has discovered an important role for these molecules in remyelination process. These findings open up novel avenues for therapeutic intervention toward curing MS. Two research communications that describe these findings will be published due to the significance.

Dr. XXX’s numerous achievements such as excellent publications in top ranked journals (which it is not necessary to reiterate here) speak for themselves and clearly show he stands out among the researchers/scientists in the field.

I obtained my B.S. at the University of California Davis, my Ph.D. through a joint graduate program with the Johns Hopkins University and the National Institutes of Health, and my postdoctoral training at the University of California San Francisco. I currently hold faculty appointments in Neurology at XXX Hospital and XXX Medical School and direct the XXX Laboratory. Given my background and exposure to scientists from many disciplines, institutions, and countries, I am qualified to comment on how Dr. XXX’s biomedical research talents have been and will be of great value to our country’s scholarly research and efforts to develop better treatments for diseases such as MS.

My current laboratory research focuses on mammalian cell stress response and gene expression. I presently serve on the Editorial board of the journal Free Radicals in Biology and Medicine and belong to the Oxygen Society and Cell Stress Society. I have published over 30 papers, mostly as first name or senior author, in peer-reviewed international journals, including the Journal of Biological Chemistry, Cancer Research, Free Radicals in Biology and Medicine and Oncogene as well as several chapters in books.
